*Message of the NGO Coalition***

Dear friends,

Some updates and *very good news* around the Human Rights Council and the
presentation of the report of the Open Ended Working Group made  by Catarina
de Albuquerque, President of the Working Group! This presentation took place
on June 4 and the Coalition delivered an oral statement to reaffirm our
commitment to the rapid adoption of the OP. We are attaching the written
statement as well as the oral one to this message.

To summarize the developments at the Council around the adoption of the
resolution and therefore of the OP text so that it can be transmitted to the
UN General Assembly (GA) for final adoption:

The last weeks were again full of uncertainty about the progress in the
process. As you might know, a group of states, led by Pakistan and Algeria,
who did not oppose the transmission of the text to the Human Rights Council
but expressed the possibility to revisit the text in relation to their
concerns on article 1 at a later stage, reopen the debate by insisting on
the inclusion of Part I and self determination in the Protocol. Although the
Coalition still supports a fully comprehensive protocol (which means no
distinction between Parts of the Covenant), reopening the fragile consensus
could be detrimental to the process as a whole and means that negotiations
could be reopened for an even worse compromise. To counter the attempts to
reopen the process, we asked you to sign up on a joint international appeal
which was sent to the states before the Council session.

We would like to take the opportunity to thank all of you who could support
the appeal in the very short timeframe.

After intense consultations in Geneva, the Portuguese, as main sponsor of
the resolution and a group of co-sponsors proposed an amended version of the
OP text and thereby found a common ground for the resolution which allows
transmitting the OP to the GA to be adopted without a vote by the Council´s
members. The new wording is to be found in article 2 (and 11 to match the
change in art.2) of the draft OP which has been adopted with the resolution
this week. Old art.2 read:
  Article 2 Communications

                Communications may be submitted by or on behalf of
individuals or groups of individuals, under the jurisdiction of a State
Party, claiming to be victims of a *violation of any of the rights set forth
in Parts II and III of the Covenant* by that State Party. Where a
communication is submitted on behalf of individuals or groups of
individuals, this shall be with their consent unless the author can justify
acting on their behalf without such consent.

And it reads now:
Article 2 Communications

                Communications may be submitted by or on behalf of
individuals or groups of individuals, under the jurisdiction of a State
Party, claiming to be victims of a *violation of any of the economic, social
and cultural rights set forth in the Covenant* by that State Party. Where a
communication is submitted on behalf of individuals or groups of
individuals, this shall be with their consent unless the author can justify
acting on their behalf without such consent.

Hoy deseamos compartir con ustedes algunas novedades y una *muy buena
noticia* acerca del Consejo de Derechos Humanos y la presentación del
informe del Grupo de Trabajo Abierto del Protocolo Facultativo al Pacto
Internacional de Derechos Económicos, Sociales y Culturales, realizada por
Catarina de Albuquerque (Presidenta del Grupo). La presentación tuvo lugar
el 4 de junio y la Coalición hizo una declaración oral para reafirmar
nuestro compromiso con una adopción veloz del PF. Adjuntamos a este mensaje
el texto de la declaración escrita  y oral (solamente en inglés).

A continuación resumimos lo ocurrido en el Consejo en relación con la
adopción de la resolución y del texto del PF para su traslado a la Asamblea
General (AG) de la ONU para su adopción final:

Una vez más, las últimas semanas hubo gran incertidumbre acerca del avance
del proceso. Como sabrán, un grupo de estados, encabezados por Paquistán y
Algeria, que no se oponían al traslado del texto al Consejo de Derechos
Humanos pero planteaban la posibilidad de revisar en una etapa posterior el
texto respecto de sus dudas sobre el artículo 1, reabrió el debate
insistiendo sobre la inclusión en el Protocolo de la Parte I y la
autodeterminación. Aunque la Coalición sigue apoyando un protocolo amplio
(es decir, sin distinguir entre las Partes del Pacto), reabrir el frágil
consenso logrado podía ser perjudicial para el proceso en su totalidad y
significaba reiniciar negociaciones que podían terminar con un compromiso
peor que el obtenido. Para contrarrestar los intentos por reabrir el
proceso, les pedimos que firmaran un llamado internacional conjunto que fue
enviado a los estados antes del período de sesiones del Consejo.

Aprovechamos esta oportunidad para agradecerles a todos los que apoyaron el
llamado dentro de un plazo muy breve.

Tras intensas consultas realizadas en Ginebra, los portugueses, como
principales promotores de la resolución, y un grupo de co-promotores
propusieron una versión modificada del texto del PF, con lo que lograron un
terreno común para la resolución que permite enviar el PF a la AG para su
adopción sin el voto de los miembros del Consejo. El nuevo texto está en el
artículo 2 (y 11, para mantener la coherencia) del borrador del PF adoptado
junto con la resolución esta semana. El art. 2 anterior decía lo siguiente:
  Artículo 2 Comunicaciones

                Las comunicaciones pueden ser presentadas por o en nombre de
personas o grupos de personas, bajo la jurisdicción de un Estado Parte, que
aduzcan ser víctimas de una *violación de cualquiera de los derechos
estipulados en las Partes II y III del Pacto* cometida por dicho Estado
Parte. Cuando se presente una comunicación en nombre de personas o grupos de
personas, la presentación deberá contar con su consentimiento, excepto que
el autor pueda justificar la presentación sin tal consentimiento.

El texto actual es el siguiente:

Voici les dernières informations et de très bonnes nouvelles concernant le
Conseil des droits de l'homme et la présentation du rapport du GTCNL par
Catarina de Albuquerque. Cette présentation a eu lieu le 4 juin et la
Coalition a fait une déclaration orale pour réaffirmer notre détermination à
ce que le PF soit adopté rapidement.  Vous trouverez ci-joint les
déclarations écrite et orale (anglais).

Voici un résumé des développements au Conseil entourant l'adoption de la
résolution et donc du texte du PF pour qu'il puisse être transmis à
l'Assemblée générale des Nations Unies (AG) en vue de son adoption
définitive.

Les dernières semaines étaient encore remplies d'incertitude quant à
l'évolution du processus. Comme vous le savez peut-être, un groupe d'États,
avec à sa tête le Pakistan et l'Algérie, qui ne s'opposaient pas à ce que le
texte soit transmis au Conseil des droits de l'homme, mais qui ont suggéré
la possibilité de revoir le texte plus tard en fonction de leurs
préoccupations concernant l'article 1, ont rouvert le débat en insistant
pour que la première partie et le droit à l'autodétermination soient
intégrés au Protocole.  Bien que la Coalition appuie toujours l'adoption
d'un protocole complet (c'est-à-dire qui ne fasse aucune distinction entre
les parties du Pacte), le fait de rouvrir le fragile consensus pourrait
nuire à l'ensemble du processus et faire en sorte que les négociations
reprennent pour aboutir à un compromis encore moins satisfaisant.  Afin de
contrer les efforts visant à rouvrir les discussions, nous vous avons invité
à adhérer à un appel international conjoint qui a été envoyé aux États avant
la session du Conseil.

Nous profitons de cette occasion pour remercier tous ceux et celles d'entre
vous qui ont pu y adhérer dans un délai si court.

Après d'intenses consultations à Genève, les Portugais, principaux
promoteurs de la résolution, ainsi qu'un groupe de co-promoteurs ont proposé

concernant la résolution, ce qui rend possible que le PF soit transmis à

refléter les modifications apportées à l'article 2) du projet de PF qui a
été adopté par la résolution émise cette semaine. L'ancien article 2 se
lisait comme suit :

groupes de particuliers relevant de la juridiction d'un État Partie, qui
