 We are approaching one of the most important moments in our fight for a
strong Optional Protocol. The *UN Open-Ended Working Group on an Optional
Protocol to the ICESCR* is meeting for its final session from 31 March to 4
April 2008. We are hoping that the Working Group can conclude its
negotiations and submit a final version of the Protocol to the Human Rights
Council for adoption. After being approved by the Council, the text of the
Optional Protocol will be sent to the UN General Assembly for adoption and
opened up for ratification by states.

The Optional Protocol will make it possible for individual, groups or
organizations acting on their behalf to seek justice at the international
level for violations of economic, social and cultural rights by submitting
complaints to the UN Committee on Economic, Social and Cultural Rights. The
adoption of the Optional Protocol will also provide support to efforts to
get greater recognition of economic, social and cultural rights in domestic
law and before courts, and will strengthen our monitoring role, as civil
society organizations.

Some states however are continuing to push for the adoption of a so called '
à la carte' Optional Protocol, under which states would be able to treat the
ICESCR as a menu of rights and specify which rights they would be willing to
accept complaints on. As the majority of states support a comprehensive
instrument that covers all levels of rights and obligations in the ICESCR,
the few states who are not willing to accept such an instrument have to be
lobbied to change or reserve their position. Some states are also pushing
for the inclusion of additional admissibility criteria such as the
requirement that a complainant demonstrates that he/she has suffered
"significant disadvantage" and to set a very high threshold for the
Committee to find a violation. There is a risk that this small group of
states may be able to prevent the Working Group from completing its work at
this session or that a much weaker text will be adopted, which would make it
harder for victims to access remedies.

The *NGO Coalition for the Optional Protocol on Economic, Social and
Cultural Rights *has prepared an appeal (attached with this e-mail) that
will be sent to Austria, Australia, Canada, Denmark, Greece, Ireland, the
Netherlands, New Zealand, Sweden, Switzerland, and the United Kingdom to
lobby them to change or reserve their position.  It is essential for the
success of our lobbying that we can demonstrate that this appeal and the
Optional Protocol have wide support. *We would therefore request you to sign
on to this appeal either as an individual or an organisation. *

session will start at the end of the month and we must convince governments
to change their positions before that.

Nos estamos acercando a uno de los momentos más importantes en nuestra lucha
por un Protocolo Facultativo efectivo. El *Grupo de Trabajo Abierto sobre un
Protocolo Facultativo del PIDESC de la ONU* llevará a cabo su período de
sesiones final desde el 31 de marzo al 4 de abril de 2008. Esperamos que el
Grupo de Trabajo pueda concluir sus negociaciones y entregar al Consejo de
Derechos Humanos una versión final del Protocolo para su adopción. Una vez
aprobado por el Consejo, el texto del Protocolo Facultativo será enviado a
la Asamblea General de la ONU para su adopción y quedará abierto para su
ratificación por parte de los Estados.

El Protocolo Facultativo hará posible que personas, grupos u organizaciones
se presenten en su propio nombre para buscar justicia en el ámbito
internacional respecto de violaciones de los derechos económicos, sociales y
culturales por medio de la presentación de reclamos frente al Comité de la
ONU sobre los Derechos Económicos, Sociales y Culturales. La adopción del
Protocolo Facultativo también representará un apoyo para los esfuerzos por
lograr un mayor reconocimiento por los derechos económicos, sociales y
culturales en las leyes nacionales y ante los tribunales, y fortalecerá
nuestra función de monitoreo, como organizaciones de la sociedad civil.

Algunos Estados, sin embargo, siguen promoviendo la adopción de un Protocolo
Facultativo "a la carta", según el cual los Estados podrían tratar el PIDESC
como un menú de derechos, especificando sobre qué derechos estarían
dispuestos a aceptar reclamos. Dado que la mayoría de los Estados apoya un
instrumento amplio que abarque todos los niveles de derechos y obligaciones
del PIDESC, es necesario presionar a los pocos Estados que no quieren
aceptar un instrumento así para que cambien o se abstengan de dar su
posición. Algunos Estados también promueven la inclusión de criterios
adicionales de admisibilidad, tales como el requisito de que el/la
peticionante demuestre que ha sufrido una "desventaja significativa" y la
definición de un umbral muy elevado para que el Comité concluya que se ha
producido una violación. Existe el riesgo de que este pequeño grupo de
Estados pueda impedir que el Grupo de Trabajo complete su trabajo en este
período de sesiones o que se adopte un texto mucho más débil, lo que
dificultaría mucho más la posibilidad de que las víctimas accedan a
reparaciones.

La *Coalición de ONG por el Protocolo Facultativo sobre los Derechos
Económicos, Sociales y Culturales* preparó una carta (adjunto a este
mensaje) que será enviada a Austria, Australia, Canadá, Dinamarca, Grecia,
Irlanda, Holanda, Nueva Zelanda, Suecia, Suiza y el Reino Unido para
presionarlos para que cambien su posición o se abstengan. Es esencial para
que nuestra campaña tenga éxito que demostremos que este llamado y el
