“transnational corporations and other business

fifth round of
negotiations this week from 14-18 October </span></span><span><span style="font-size:11.0pt" lang="EN-US">at the UN</span></span><span><span style="font-size:11.0pt" lang="EN-US"> Human Rights
Council. During this session</span></span><span><span style="font-size:11.0pt" lang="EN-US">,</span></span><span><span lang="EN-US"> UN member
states will</span></span><span><span style="font-size:11.0pt" lang="EN-US"> negotiate the second
draft</span></span><span><span style="font-size:11.0pt" lang="EN-US"> of this ground-breaking
treaty that aims to </span></span><span><span style="font-size:11.0pt" lang="EN-US">hold</span></span><span><span style="font-size:11.0pt" lang="EN-US"> transnational
corporations to account for their human
rights violations. </span></span></p>
<p><span><span style="font-size:11.0pt" lang="EN-US">Interest in this process
continues to grows as evidenced in the significant presence
of UN member states
delegates, civil society and e</span></span><span><span style="font-size:11.0pt" lang="EN-US">lected

regional and national parliaments, as well as municipal
authorities have
endorsed the Call of People’s Representatives Worldwide for
the UN Binding

week to present their

systems and multinationals have captured the Ecuadorian
State over the last two
years. That is why a binding treaty is needed, which returns
sovereignty to
peoples and states. But it is also clear to us that a UN
binding treaty that is
not accompanied by sustained social action will not be
effective. As
exemplified by recent events in Ecuador over the past ten

The historical
importance of this binding treaty process to end, once and for
all, the
impunity of transnational corporations and guarantee access to
justice for

ONU: esta semana los estados inician negociaciones
sustanciales sobre el texto

<br>
El Grupo de Trabajo Intergubernamental (IGWG) de las Naciones
Unidas (ONU) que
discute un tratado sobre “corporaciones transnacionales y
otras empresas con
respecto a los derechos humanos” (1) entra en su quinta ronda
de negociaciones
esta semana del 14 al 18 de octubre en el Consejo de Derechos
Humanos de la
ONU. Durante esta sesión, los estados miembros de la ONU
negociarán el segundo
borrador de este innovador tratado que tiene como objetivo
hacer que las corporaciones
transnacionales rindan cuentas por sus violaciones de derechos
humanos.<br>
<br>
El interés en este proceso continúa creciendo como lo
demuestra la importante
presencia de delegados de los estados miembros de la ONU, la
sociedad civil y funcionarios
electos de todo el mundo. 321 miembros de parlamentos
regionales y nacionales,
así como autoridades municipales, han respaldado el Llamado de
Representantes
del Pueblo en todo el mundo para el Tratado vinculante de la
ONU (2)<br>
<br>
<b>Charles Santiago</b>,
miembro del
Parlamento de Malasia, declaró: "Los precios de los
medicamentos son muy
altos y la gente muere como consecuencia. Esto es resultado de
los monopolios
controlados por las empresas transnacionales (ETNs). El
movimiento emergente
que enfrenta el poder de las ETNs y presiona para la creación
de reglas
vinculantes de las Naciones Unidas sobre las ETNs es alentador

Movimiento de Afectados por Represas de Brasil, dijo: "Estamos
preocupados
por el contenido del borrador revisado presentado para su
discusión esta semana
porque no refleja muchas de nuestras principales
preocupaciones y propuestas.
En particular, el tratado necesita un enfoque principal en las
ETNs, como se
indica en la resolución original 26/9, para abordar la
impunidad corporativa
que vemos en el mundo ". (3)<br>

<b>Kea Seipato</b>,
coordinadora de la
sección de la región Sudafricana de la Campaña Global para
Recuperar la
Soberanía de los Pueblos, Desmantelar el Poder Corporativo y
Poner Fin a la Impunidad
(3), enfatizó que, “Los pueblos de la región Sudafricana están
pidiendo un
desarrollo autodeterminado y está exigiendo un Tratado que
garantice eso. Piden
el 'Derecho a decir No' al saqueo de sus recursos por parte de
las ETNs”.<br>

<b>Pablo Fajardo</b>,
representante de la
Unión de Personas Afectadas por Chevron-Texaco en Ecuador (4),
dijo: "Los
sistemas financieros internacionales y las multinacionales han
capturado al
Estado ecuatoriano en los últimos dos años. Es por eso que se
necesita un
tratado vinculante, que devuelva la soberanía a los pueblos y
estados. Pero
también nos queda claro que un tratado vinculante de la ONU
que no esté
acompañado de una acción social sostenida no será efectivo.
Como lo demuestran
los recientes acontecimientos en Ecuador en los últimos diez
días ".<br>
<br>
<b>Karin Nansen</b>,
presidenta de Amigos
de la Tierra Internacional (6) dijo: "Los defensores del medio
ambiente y
los derechos humanos están en la primera línea de resistencia
a las violaciones
cometidas por las empresas transnacionales, soportando ataques
sistemáticos de
intimidación, silenciamiento y asesinatos. La importancia
histórica del
proceso de este tratado para finalizar de una vez por todas
con la impunidad de
las corporaciones transnacionales, y garantizar el acceso a la
justicia para
los afectados, no puede exagerarse ".<br>
<br>
Hoy, activistas internacionales actuaron frente al Palacio de
las Naciones,
representando cómo las corporaciones transnacionales usan los
mecanismos de
Solución de Controversias entre Inversores y Estados (ISDS por
sus siglas en
inglés) para demandar a los estados que implementan
regulaciones para proteger
las normas laborales o el medio ambiente. La acción es parte
de una gira que
viaja desde Ginebra a Viena, donde hoy la Comisión de Comercio
de las Naciones
Unidas,( UNCITRAL por sus siglas en inglés), inicia
negociaciones sobre una
reforma del sistema ISDS. (7) (8)<br>

El <b>Dr. Thomas Köller</b>
de Attac
Alemania comentó: "Hacemos un llamamiento a los gobiernos
europeos y a la Unión
Europea (UE) para que participen de manera constructiva en las
negociaciones
sobre el Tratado vinculante de la ONU en Ginebra, como el
Parlamento de la UE
ha exigido reiteradamente. En Viena, la UE debe retirar su
impulso para un
tribunal multilateral de inversiones ".<br>
