<p class="MsoNormal" style="text-align: justify;">Yesterday, Colombian
NGOs filed requests for an open compulsory license on AIDS drug
lopinavir/ritonavir (Abbott's Kaletra) with the Colombian government.
The NGOs delivered request letters to the Superintendencia de Industria
y Comercio, which houses the patent office, as well as to the office of
the President of the Republic. Additionally, the NGOs delivered a
letter to the Ministry of Health, requesting a declaration of public
interest in access to lopinavir/ritonavir. </p>
<p class="MsoNormal" style="text-align: justify;">The compulsory
license request comes three months after Colombian civil society
requested an open license for lopinavir/ritonavir directly from Kaletra
manufacturer and patent holder Abbott Laboratories. To date, Abbott
has not responded to the groups' request. </p>
<p class="MsoNormal" style="text-align: justify;">Below, please find my
translation of the letter Colombian NGOs delivered to the
Superintendencia de Industria y Comercio yesterday in Bogotá. The
original Spanish follows my translation (all translation errors are
mine). </p>
<p class="MsoNormal" style="text-align: justify;">The letters were
accompanied by appendices and a technical document, approximately
twenty pages in length, analyzing potential cost savings, legislation,
drug quality, license procedures, human rights and AIDS treatment
accords, lopinavir/ritonavir indications, and the medicine's importance
to national programs.</p>

<div class="MsoNormal"><span style="">The license would authorize any
person, business or company to use any patented invention owned in the
Republic of Colombia by Abbott Laboratories and its affiliates,
including patents held in common by Abbott Laboratories and other
entities, to produce, manufacture, import, export, distribute, offer in
liquidation, sell, purchase or use the medicine known commercially as
Kaletra (lopinavir/ritonavir), in accordance with the authority
established under Article 65 of Andean Community Decision 486, and
Resolution 17585/01 of the Superintendency of Industry and Commerce.<span
style=""> </span><O:P></O:P></span></div>
<div class="MsoNormal"><span style=""> <O:P></O:P></span></div>
<div class="MsoNormal">The request is founded in the following: <O:P></O:P></div>

<div class="MsoNormal">The Public Interest<O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">Lopinavir / ritonavir is a key medicine in
HIV/AIDS treatment.<span style=""> </span>Calculations
based on data from a study by the Ministry of Social Protection and
U.N.AIDS indicate that in 2005, nearly 1,275 people living with
HIV/AIDS in Colombia were taking Kaletra.<span style=""> </span>A
survey of health organizations reported that Kaletra use grew from 3
million units in 2004 to more than 6 million units in 2006.<span
style=""> </span>That is to say, Kaletra consumption doubled in a
period of just two years.<span style=""> </span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">The price of medicines in the Colombian market
constitutes a barrier to access.<span style=""> </span>In
the case of Kaletra, patents have permitted Abbott to maintain prices
higher than a competitive market would bear. Considering only the lower
prices offered to public institutions, Kaletra’s current Colombia price
is about $1,683USD per patient, per year. (Prices for private
institutions are higher, and reach $4,449 per patient per year.)<span
style=""> </span>Multiplying
the public sector price by the number of patients, Kaletra currently
costs Colombia’s public health system about $2,144,633 per year.<span
style=""> </span>Meanwhile, high-quality generic versions of
lopinavir/ritonavir are available in many countries with prices under
$800.<span style=""> </span>Through
a recent agreement between the Clinton Foundation and generics firms,
prices can reach $550 per patient, per year, 67.3% cheaper than
Abbott’s product in Colombia.<span style=""> </span>A license
authorizing generic competition would enable a significant and
immediate change in the cost of this medicine in Colombia.<span style="">
</span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">Studies by organizations signing this letter,
and studies by the Office for the Defense of the Public, show that the
high price of Kaletra constitutes a barrier to access and an assault on
patients’ rights, in two ways.<span style=""> </span>First, given
limited state resources, high prices set back the expansion of coverage.<span
style=""> </span>The promise of universal coverage cannot be
realized in practice.<span style=""> </span>Second,
patients receiving high-cost medicines through state programs or
insurance agreements endure long lines, legal forms, stigma and
discrimination, both subtle and expressly stated. More than a few
patients abandon treatment to avoid these problems, putting their own
lives at risk.<span style=""> </span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">A compulsory license for lopinavir/ritonavir in
Colombia would allow the state to obtain and offer imported generics,
as well as permit the local production of lopinavir/ritonavir.<span
style=""> </span>The
result could be greater product availability for patients, robust
competition, and savings for the state, which could be directed to
other public needs.<span style=""> </span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">In recent years, Brazil, Indonesia, Malaysia,
Mozambique, South Africa, Zambia Eritrea and Thailand have issued
compulsory licenses to promote access to medicines.<span style=""> </span>Indeed,
governments of many countries, including the United States, make use of
compulsory licenses in a wide variety of circumstances.<span style="">
</span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">A comparative analysis of costs and coverage in
the Andean region makes clear that Colombia finds itself at a
disadvantage. (See Technical Document, attached, Chapter 5.)<span
style=""> </span>Lack of access to ARVs for people living with
HIV/AIDS means a rise in morbidity and mortality.<span style=""> </span>This,
in addition to making vulnerable the Right to life and to health,
increases costs to the state of caring for those who fall ill.<span
style=""> </span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">Of Right: <O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">Under Article 65 of Andean Community Decision
486, and Article 31 of the WTO TRIPS agreement, Colombia has the right
to grant compulsory licenses on public interest grounds, and authorize
generic competition with patented pharmaceuticals. Under this
authority, the generics may be produced locally or imported; the only
condition is that they pay a reasonable remuneration to the patent
holder.<span style=""> </span>This license request suggests license
terms following international standards (attached).<span style=""> </span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">Under TRIPS Article 31(b), before issuing a
compulsory license, proposed users should seek to obtain voluntary
licenses under reasonable terms, until a reasonable period has passed
(normally three months or less).<span style=""> </span>On April 7,
2008, the Working Group of HIV/AIDS Organizations and RECOLVIH filed an
open license request for lopinavir/ritonavir at the main Bogotá offices
of Abbott Laboratories.<span style=""> </span>To date, the Working
Group and RECOLVIH have received no response.<span style=""> </span>Hence,
the present request letter for a compulsory license.<span style=""> </span><O:P></O:P></div>
<div class="MsoNormal"> <O:P></O:P></div>
<div class="MsoNormal">The right to life, the right to real and
effective equality and the right to access to health services are
fundamental and social constitutional rights.<span style=""> </span>Further,
and also by constitutional mandate, property has a social function.<span
style=""> </span>Finally, in accordance with principles of economy
and transparency, state resources must be used optimally.<span style="">
</span>Reducing costs and increasing coverage are public interest
priorities. <O:P></O:P></div>

sus afiliados, incluyendo patentes poseídas en común por Laboratorios
Abbott y otras entidades, para producir, manufacturar, importar,
exportar, distribuir, ofrecer en liquidación, vender, comprar o usar el
medicamento denominado comercialmente Kaletra</span><font
class="Apple-style-span" face="Verdana">® </font><span style=""><span
style=""> </span>(lopinavir/ritonavir)</span><font
class="Apple-style-span" face="Verdana">
de acuerdo con la autoridad establecida bajo el artículo 65 de la
Decisión 486 de la Comunidad Andina y la Res 17585/01 de la SIC. </font><span

es un medicamento clave en el tratamiento de la infección por VIH/SIDA.
Cálculos basados en los datos de un estudio encargado por el Ministerio
de Protección Social y ONUSIDA</font><a style="" href="#_ftn1"
name="_ftnref1" title=""><span class="MsoFootnoteReference"><span
style=""><font class="Apple-style-span" face="Verdana">[1]</font></span></span></a><font
class="Apple-style-span" face="Verdana"> indican que en el país</font><span
style=""><font class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">en el 2005, cerca de 1.275
personas viviendo con VIH o SIDA (PVVs)</font><span style=""><font
class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">tomaban Kaletra®. De otra
parte, una muestra de entidades del sistema de salud Colombiano</font><a
style="" href="#_ftn2" name="_ftnref2" title=""><span style=""><font
class="Apple-style-span" face="Verdana" size="2"><span
class="Apple-style-span" style="font-size: 10px;">[2]</span></font></span></a><font
class="Apple-style-span" face="Verdana">
reporta que el consumo en unidades de este medicamento pasó de
aproximadamente 3 millones de unidades en 2004 a más de 6 millones en
2006. Es decir que en dos años el consumo de este medicamento se
duplicó.</font><O:P></O:P></span></p>
<pre style="text-align: justify;"><span style="background-color: aqua;"
lang="ES-TRAD"><font class="Apple-style-span" face="Verdana"> </font><O:P></O:P></span></pre>
<p class="MsoNormal" style="text-align: justify;"><span style=""
lang="ES-TRAD"><font class="Apple-style-span" face="Verdana">El
precio de los medicamentos en el mercado Colombiano constituye una
barrera de acceso, y en el presente caso la patente del Kaletra® ha
permitido mantener precios mayores de los que se tendría si existiera
competencia. Para 2008, Kaletra® </font><span style=""><font
class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">cuesta
al Estado Colombiano aproximadamente $1683 USD por paciente al año,
considerando los precios más bajos ofrecidos a instituciones públicas.
(Los precios para instituciones privadas son más altos, y llegan hasta
$4449 por paciente al año)</font><span style=""><font
class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">En
consecuencia, si todo el sistema estatal comprará a $1683USD y teniendo
en cuenta el numero de PVVS citado arriba, este medicamento le estaría
costando al sistema de salud colombiano</font><span style=""><font
class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">$2.144.633
USD por año. Por otro lado, versiones genéricas de lopinavir/ritonavir
con incuestionables estándares de calidad están disponibles en muchos
países con precios menores a $800 USD. A través de un acuerdo entre las
casas genéricas y la Fundación Clinton, los precios pueden reducirse a
$550 USD por paciente año, 67.3% más económico que el producto de
Abbott en Colombia. Una licencia que autorice la competencia de los
genéricos en el mercado permitiría un cambio drástico e inmediato en el
costo de dicho medicamento en Colombia.</font><O:P></O:P></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style=""
lang="ES-TRAD"><font class="Apple-style-span" face="Verdana"> </font><O:P></O:P></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style=""
lang="ES-TRAD"><font class="Apple-style-span" face="Verdana">Estudios
realizados por algunas de las instituciones representadas en esta
solicitud, y los estudios realizados por la Defensoría del Pueblo,
muestran que el alto precio de este producto constituye una barrera al
acceso y una agresión a los derechos de los pacientes por dos
mecanismos; de una parte retrasa la ampliación de la cobertura del
sistema de seguridad social en salud pues, por razones de costo y de
limitación de recursos, la prometida cobertura universal no puede
llevarse a la práctica; de otra parte, aquellos pacientes que gozan de
un seguro ya sea en el régimen contributivo o en el subsidiado, o
cubiertos por los entes territoriales, observan como cada entrega del
medicamento (que usualmente es mensual) significa soportar una
pesadilla de colas, desplazamientos, recursos legales(incluyendo tutela
para un producto incluido en el POS) y con frecuencia sutiles o
expresos mecanismos de estigma y discriminación.</font><span style=""><font
class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">No pocos pacientes abandonan
el tratamiento para evitar estos problemas poniendo en riesgo incluso
su propia vida. </font><O:P></O:P></span></p>

las cosas una licencia obligatoria para lopinavir/ritonavir en Colombia
permitiría que el Estado obtenga y ofrezca genéricos importados y
también permitiría la producción local de lopinavir/ritonavir.</font><span
style=""><font class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">El
resultado sería una mayor disponibilidad del producto para los
pacientes, una mayor competencia y un ahorro para el Estado, que podría
ser dirigido a otras necesidades públicas.</font><span style=""><font
class="Apple-style-span" face="Verdana"> </font></span><O:P></O:P></span></p>

<p class="MsoNormal" style="text-align: justify;"><span style=""

años recientes, Brasil, Indonesia, Malasia, Mozambique, Sudáfrica,
Zambia, Eritrea y Tailandia han emitido licencias obligatorias para
promover el acceso a medicamentos.</font><a style="" href="#_ftn3"
name="_ftnref3" title=""><span class="MsoFootnoteReference"><span
style=""><font class="Apple-style-span" face="Verdana">[3]</font></span></span></a><font
class="Apple-style-span" face="Verdana">
En efecto, los gobiernos de muchos países, incluido el de Estados
Unidos, hacen uso de licencias obligatorias en una amplia variedad de
circunstancias.</font><span style=""><font class="Apple-style-span"
face="Verdana"> </font></span><O:P></O:P></span></p>
<p class="MsoNormal" style="text-align: justify;"><span style=""
lang="ES-TRAD"><font class="Apple-style-span" face="Verdana"> </font><O:P></O:P></span></p>
<p class="MsoNormal" style="text-align: justify; margin-bottom: 10pt;"><span
style="" lang="ES-TRAD"><font class="Apple-style-span" face="Verdana">Realizando
un análisis comparativo de costos y cobertura con los países de la
región, es claro que Colombia se encuentra en desventaja. (Ver
Documento Técnico, anexo, Capítulo 5). La falta de acceso a
medicamentos ARV para las PVVs (personas que viven con el virus del
VIH), significa aumento en la morbilidad y mortalidad. Esto, además de
vulnerar el Derecho a la vida y a la salud, aumenta los costos de la
respuesta nacional en atención y cuidado de los que se enferman. </font><O:P></O:P></span></p>

el articulo 65 de la Decisión 486 de la Comunidad Andina y el artículo
31 del Acuerdo sobre los Derechos de Propiedad Intelectual relacionados
con el comercio (ADPIC) de la Organización Mundial de Comercio,
Colombia tiene el derecho de emitir licencias obligatorias por razones
de Interés Público, para autorizar la competencia de medicamentos
genéricos, cuando un producto farmacéutico está patentado. En este
marco, los genéricos pueden ser de producción local o importados, la
única condición es que se paguen derechos razonables al titular de la
patente. Se sugieren condiciones de comercialización según estándares

class="Apple-style-span" face="Verdana">En el marco del Articulo 31(b) de los ADPIC, antes de asignar una licencia obligatoria, los usuarios deben buscar obtener licencias voluntarias con términos razonables, hasta que haya transcurrido un periodo razonable (normalmente tres meses o menos).</font><span
style=""><font class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">El día 7 de Abril del presente año, la Mesa de organizaciones con trabajo en VIH/sida y Recolvih radicaron una solicitud de Licencia Voluntaria Abierta para lopinavir/ritonavir en la oficina principal de Abbott Laboratorios.</font><span
style=""><font class="Apple-style-span" face="Verdana"> </font></span><font
class="Apple-style-span" face="Verdana">Hasta la fecha, no ha habido respuesta alguna, razón por la cual se realiza la presente solicitud, ya que este asunto es de carácter prioritario.</font><O:P></O:P></span></pre>

derecho a la vida, el derecho a la igualdad real y efectiva y el
derecho al acceso a servicios de salud son derechos fundamentales y
sociales de rango constitucional. De otra parte y también por mandato
constitucional la propiedad tiene una función social. Y finalmente, de
acuerdo con los principios de economía y transparencia, los recursos
del Estado deben utilizarse de una manera óptima, disminuyendo los
costos</font><span style=""><font class="Apple-style-span"

face="Verdana">y aumentando la cobertura</font><span style=""><font
