PHM-Exch> Launch of an Archive in Memory of Heesob Nam

Dear colleagues,

It's already been two years since our colleague, Heesob, passed away. 

In memory of him, South Korean civil society has opened an archive of his activities. It is a collection of columns, articles, speeches, reports, and presentations he had made until he left.

Heesob pioneered the criticism of intellectual property rights and the expansion of access to knowledge in South Korea. Korean civil society has established this [Heesob Nam Archive 남희섭 아카이브] to share his achievements and build on them so that someone else can break new ground.

We hope that [Heesob Nam Archive 남희섭 아카이브] can serve as a resource for understanding information, culture, and human rights he envisioned and inspire real-world issues.

In memory of patent attorney Nam Heesob, who fought against vaccine inequality until his end

그를 처음 만난 것은 1999년경으로 기억한다. 1994년에 출범한 세계무역기구(WTO)에 한국 사회운동의 관심은 주로 농업 분야의 피해에 집중돼 있었고, 지적재산권 협정(TRIPs)에 대한 인식은 그리 깊지 않았다. 지적재산권에 대한 비판적인 인식은 디지털 문제에 관심이 있는 비교적 젊은 활동가들 중심으로 서서히 싹트기 시작했다. 1999년 2월, 지적재산권 토론회가 개최됐는데 당시 정보공유 운동에 관심이 많았던 필자도 발제자로 참여했다. 이후 몇몇 사람들이 ‘지적재산권 연구회’라는 이름으로 학습 모임을 시작했다. 그러던 어느 날, 우리의 문제의식에 공감한다며 남희섭 형이 찾아왔다. 훗날 이 단체는 정보공유연대 IPLeft로 발전했고, 그는 활동가로 시작해 대표까지 역임했다.

특허와 같은 독점권에 비판적

그는 변리사였다. 변리사는 특허, 상표와 같은 지적재산의 등록 등 관련 사무를 대리하는 사람이다. 당연히 변리사 입장에서는 특허를 받고자 하는 사람이 많으면 좋을 것이다. 그런데 그는 특허와 같은 독점권에 매우 비판적인 시각을 가진 독특한 변리사였다. 그는 그다지 혁신적이지 않은 발명이 특허를 받는 것을 불합리하다고 느꼈다. 이런 맥락에서 그는 특허료를 주 수입원으로 하는 특허청이 특허권 부여를 남발하는 것에 대해 특허 장사라고 비판했다. 또한 특허건수를 늘리고 독점권을 강화하면 혁신이 이루어진다는 근거 없는 믿음, 특허허브국가론과 같은 국가정책 기조에 대해 평생을 문제 제기해왔다. 그의 비판은 단지 이론에 머물지 않았다. 법적·실무적 전문성을 바탕으로 그는 왜곡된 지적재산권 법제도를 바로잡기 위해 애써왔다. 그가 아니었다면 한국의 지적재산권 제도는 소수 전문가만의 놀이터였을지 모른다.

그는 의약품 접근권 운동에 앞장선 투사였다. 전 세계적으로 특허를 둘러싼 가장 큰 논란은 의약품 접근권 문제인데, 특허로 인한 독점은 의약품의 가격을 상승시키며 약이 있어도 환자들이 약에 접근하지 못하는 부조리가 발생한다.

2000년대 초반 국내에서는 만성골수백혈병 치료제인 글리벡이 논란이 됐다. 혁신적 신약이었지만, 한알에 약 2만5000원이라는 높은 가격이 책정된 글리벡을 부담할 수 있는 환자들은 많지 않았다. 약가 인하와 보험적용을 요구했던 환자들에게 강제실시라는 또 하나의 방법을 제시했던 것이 남희섭 형이었다. 강제실시란 공중의 건강 보호와 같은 공공의 이익을 위해 특허권자의 허락이 없이도 제3자가 특허 발명을 할 수 있도록 하는 제도이다. 그러나 국내에서는 법문으로만 존재하는 제도일 뿐 제대로 활용된 적이 없었다.

강제실시 청구 서류 양식도 없었던 2002년 1월, 그는 글리벡에 대한 강제실시를 청구했다. 하지만 특허청은 특허제도의 기본취지를 크게 훼손할 수 있다는 이유로 기각하고 말았다.

그러나 그가 지원한 환자들의 투쟁으로 보험적용이 확대되는 등 환자들의 의약품 접근성이 확대됐다. 또한 그는 보험적용이 되지 않는 환자들을 위해 인도 제약사인 나코로부터 글리벡의 복제약인 비낫을 수입할 수 있도록 지원했다. 비낫의 가격은 글리벡의 7분의 1인 3달러에 불과했다. 그는 제도적 한계를 해결하기 위해 특허법 개정을 위해 노력한 결과, 제조능력이 미흡한 나라의 환자를 위한 수출 목적 강제실시 제도와 정부사용 강제실시 제도의 개정을 이끌어내기도 했다.

그는 한 국가의 지적재산권 제도가 산업과 문화 발전을 위한 자국의 필요에 의해서가 아니라 초국적 기업과 강대국에 의해 강압적으로 만들어지는 것에 분개했다. 한국 역시 예외가 아니었다. 2006년 한미 자유무역협정(FTA) 협상이 개시되자, 그는 ‘지적재산권 분야 대책위원회’를 구성하고 한미 FTA의 지적재산권 협상이 문화 및 의약품에 대한 접근권에 미칠 해악을 분석하고 비판하는 데 앞장섰다. 면밀한 논리로 지적재산권 조항의 문제점을 지적하며 투명하고 민주적인 통상 협상을 요구했던 그는 비밀리에 한미 FTA 협상을 추진하던 한국정부에게 오히려 협상 상대방보다 껄끄러운 사람이었을지 모른다.

강대국에 의한 지적재산권 분개

그는 인권의 관점에서 지적재산권을 둘러싼 담론 자체를 재구성하고자 했다. 지식에 대한 독점권이 정당한 권리가 되고, 지식에 대한 접근권은 ‘권리에 대한 예외’가 되는 담론 하에서 제도 개혁 운동은 한계를 가질 수밖에 없기 때문이다. 그는 독일과 영국으로 유학을 떠났고, ‘지적재산권과 인권’을 주제로 박사 학위를 받았다. 2013년 국가인권위원회가 발간한 ‘정보인권 보고서’에 프라이버시권, 표현의 자유 등과 함께 정보문화향유권을 포함시킨 것은 그의 공헌이다.

세계인권선언과 유엔 사회권 규약은 모든 사람이 문화를 향유하고 과학기술의 혜택을 공유할 권리를 가지고 있음을 명시하고 있지만, 그 이전에는 지적재산권에 대응하는 지식과 문화에 대한 접근권은 제대로 인권으로서 규정되지 못했다. 2018년 정부와 국회에서 개헌에 대한 논의가 활발했을 때, 그는 헌법상 권리로서 ‘과학문화권’의 신설을 주장했다.

코로나19라는 전 세계적인 감염병 재난 앞에서 그가 일평생을 싸워왔던 지식의 공유와 개방이라는 가치는 더욱 절실해지고 있다. 엄청난 공적 자금을 지원받아 백신이 개발됐지만, 거대 제약회사의 탐욕과 백신 국수주의에 가로막혀 가난한 나라 민중의 백신 접근권은 배제되고 있기 때문이다. WTO의 지적재산권 조항을 유예하라는 국제적인 목소리가 호응을 얻고 있는 지금 안타깝게도 그는 우리 곁에 없다.

올해 초 그는 ‘의료 기술의 공공성 복원과 팬데믹 극복을 위한 지재권 공개 특강 시리즈’를 마련했다. 홍보문을 접하는 순간, 이 특강이 그의 마지막 사업이라는 것을 직감했다. 이미 수년 전부터 암투병을 이어왔고, 최근에 상황이 악화됐다는 얘기를 들었기 때문이다. 강의 내내 밭은기침을 콜록대고 목소리가 잦아들어 갔지만, 그는 자신이 아는 것을 조금이라도 더 설명하려고 애썼다.

나는 그와 20년을 만났지만, 그의 지식과 열정을 도저히 따라갈 수 없었다. 그는 매우 섭섭했을지 모르겠다. 아무도 그를 대체할 수는 없겠지만, 그를 아는 우리 모두 그의 과업을 이어나가야 한다.

이 지면을 빌려 존경하는 동지이자 사랑하는 선배였던 희섭 형에게 마지막 인사를 전한다. ‘형, 이제 모든 것을 내려놓고 푹 쉬기를 바랄게.’

It is our deepest sorrow that our colleague Heesob Nam (1966-2021), a South Korean IP activist, passed away today 10 May 2020.

I believe many of you have been his longstanding friends or colleagues. 

He had lived with cancer for the last several years but worked even harder and more passionate to reform the IP regime locally and globally. During the last months, he drafted the resolution supporting the TRIPS waiver proposal and the patent law amendment for the Korean National Assembly and mobilized legislators to propose these. He had also organized series of webinars on the political economy of TRIPS and TRIPS-plus in the COVID-19 era to which some of you had been invited. 

He was a legendary IP activist, with a tireless drive for social change. It is our great loss. 

We will continue the movement that Heesob helped to chart.
