PHM-Exch> Right to Health (Care) Act

Dear David, Claudio and Anneleen:

The PHM Rajasthan chapter successfully campaigned for launch of free
medicines and diagnostics to everybody and it was rolled out in 2011
without any exclusion of any kind in the state of Rajasthan ( for 78
million people of the state and several thousands from neighbouring states
as no questions are asked about domicile). It was the result of continuous
aggressive pressure through campaigns of JSA Rajasthan and because of the
benefits these schemes bestowed that even a political party which initially
vehemently opposed these schemes when came in power between 2013 - 2018
could neither stop or down size them.

Now in 2018, during the Rajasthan sate elections held in December, PHM
Rajasthan put demand for enactment of Right to Health (Care) Act for
inclusion in the political manifestos of all the political parties
contesting elections. Congress party which won the election had included
this demand in its  manifesto and converted its manifesto into the
government commitment document after cabinet  approval. Jan Swasthya
Abhiyan Rajasthan has drafted a bill and sought some important inputs from
some of the colleagues of JSA India.  Copy of the bill is attached. It will
be great to have your comments on the bill and with a request that it could
be put on PHM web site and circulated in PHA Exchange. If this bill is
legislated with the obligations written, then Rajasthan would be the first
state to do so in India. Officials of the government do ask us that if
there is any country which has passed such an act?
