Greetings from Geneva.
Today at the second session of the Human Rights Council here in Geneva,
Brazil tabled a draft resolution on access to medication, which would mandate
the UN Secretary General to conduct a study in the impact of intellectual
property on access to medications, especially for HIV/AIDS, malaria and TB.
The first round of negotiations is scheduled for this afternoon. The draft
resolution pasted below.

Access to medication in the context of pandemics such
as HIV/AIDS, tuberculosis and malaria
The Human Rights Council,
Recalling all the previous resolutions concerning the access to medication
in the context of pandemics such as HIV/AIDS, tuberculosis and malaria that
were approved by the Commission on Human Rights; and
Considering the operative paragraph 6 of the General Assembly Resolution
60/251 that has established the Human Rights Council;
1. Requests that Secretary-General to continue to solicit comments from
Governments, United Nations organs, programmes and specialized agencies and
international and non-governmental organizations on the steps they have taken
to improve access to medication in the context of pandemics such as HIV/AIDS,
tuberculosis and malaria and to submit the report to the Human Rights Council,
at its fourth session;
2. Also requests the Secretary-General, based on consultations with
Governments, United Nations organs, programmes, specialized agencies and
international and non-governmental organizations, to conduct a study on the
possible impacts of intellectual property rights on the access to medication
in the context of pandemics such as HIV/AIDS, tuberculosis and malaria and on
the possible means of exploring new and innovative financing mechanisms which
can help to improve the access to the medication that fight those pandemics
and submit the report to the Human Rights Council, at its fourth session.
